With the FCC poised to vote on ending the Title II protections which safeguard a neutral internet in just a few days Congressman Sean Patrick Maloney (D-NY 18) has proposed H.R 4585 — To prohibit the Federal Communications Commission from relying on the Notice of Proposed Rulemaking in the matter of restoring internet freedom to adopt, amend, revoke, or otherwise modify any rule of the Commission.

The title is a mouthful but the premise is pretty simple.

Despite being called the “Save Net Neutrality Act,” H.R 4585 technically doesn’t take a position for or against Net Neutrality. Instead, it calls out the cartwheeling fireball of abject failure that has been the FCC’s formal comment period on the issue and prevents the Commission from using it as a vehicle to repeal Title II Net Neutrality protections.

While it may be difficult to get Congress to agree on how the internet should be run it should not be difficult to agree on how the FCC should be run. Existing law requires that the FCC consider public comment as part of its rule making process; it can’t claim to have done that when 97% of the comments it received remain unverified as originating from real accounts belonging to real Americans.
